Installment Sale Arrangements
What CA TD Investments, Inc. will accomplish for you.
We will enable you to sell your real property, receive a market rate of return on equity and defer all or part of your income tax.
This is accomplished by using section 453 of the Internal Revenue Code, see “6252 & Instructions“, attached.
How it works:
CA TD Investments, Inc., “CATD”, buys your property paying you with cash and an installment note, subject to any loans you have outstanding. CATD then sells the property to a pre-arranged buyer at a price you negotiated, pays off any selling expenses and existing loans and is left with an amount equal to the cash to be paid to you plus an amount equal to the installment note. You will then be paid the cash and given the original note. You will pay tax on any cash received. See the Sample Note and Collateral Agreement for the usual note terms.
Attached are several files. The first is a Sample Note and Collateral agreement. This is similar to a note you would sign upon sale of your property. Also attached is a Summary Collateral Document, “Sample Addendum“. This document lets you know a bit about the property and terms on the note that is your collateral. Further I have attached a sample appraisal, some information bulletins on typical properties and the IRS section on Installment Sales.
You will receive a summary of each of the notes held as collateral for you. Further, I maintain details on the property and borrower in my office for review. This includes a full appraisal of the property. We will discuss each note purchased so that you are comfortable with your collateral.
What we look for:
- First Trust Deeds: We do not want to be at risk to pay on a first mortgage if we take back a property.
- 65% Loan to Value We want the borrower to have a significant investment in the property. (I have taken some notes as high as 68%)
- Diversification We look for a mixture of property types, residential, multifamily, commercial and land.
- Secure Investment We assess both the property and the borrower to ensure repayment.
